Welcome to WhirlAway Travel. By accessing our website, submitting an inquiry, engaging our services, or traveling on an itinerary arranged by WhirlAway Travel LTD (“WhirlAway Travel,” “we,” “us,” or “our”), you acknowledge and agree to the following Terms, Conditions, Service Agreement, and Privacy Policy.


SERVICE AGREEMENT

1. Planning Fees and Trip Cancellation Fee

You agree to pay the WhirlAway Travel planning fees for the scope of work as stated in your Trip Consultation Summary or proposal documentation. To begin work, an initial planning fee payment may be required. The travel planning service fee balance is due once the trip itinerary is approved by you.


The Travel Planning Fee is separate from the cost of your trip. Our fees are non-refundable.


WhirlAway Travel reserves the right to charge additional planning fees if the scope of the trip or the planning services required change, regardless of the reason for the change.


A cancellation fee may be charged if you cancel a confirmed trip, in addition to any supplier-imposed penalties.


2. Travel Documents

You agree to review your itinerary and other travel documents for accuracy and to inform us within 24 hours of any issues.


The names on your travel documents must exactly match the government-issued identification you will use for travel.


3. Quotes and Confirmations

You acknowledge availability and prices may be subject to change until deposit is paid and confirmation is complete.


You acknowledge that pricing for flights may not include seat assignments, baggage fees, or other airline-imposed charges.


You further acknowledge that quotes and pricing are provided as a total for a complete itinerary and that WhirlAway Travel does not provide line-item pricing for each component of a custom itinerary.


4. Agent for Suppliers

WhirlAway Travel acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, destination management company, or other service provider named in your itinerary or confirmation (“Suppliers”).


We are not responsible for the acts or omissions of Suppliers or their failure to adhere to schedules, provide services or refunds, financial default, or failure to honor future travel credits.


We have no special knowledge regarding the financial condition of Suppliers and no liability for recommending a travel credit in lieu of a refund.


5. Risks of Travel and Release

We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or for acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, labor disputes, governmental actions, transportation interruptions, or the suitability for a disabled person of any portion of any trip.


We have no special knowledge of dangers during travel or at destinations.

It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and restrictions.


YOU HEREBY EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH TRAVEL AND AGREE TO RELEASE, DISCHARGE, AND HOLD HARMLESS WHIRLAWAY TRAVEL, ITS OWNERS, EMPLOYEES, OFFICERS, ADVISORS, AFFILIATES, AND REPRESENTATIVES FROM ANY LIABILITY, CLAIMS, DAMAGES, OR CAUSES OF ACTION ARISING FROM OR RELATED TO SUCH RISKS.


6. Foreign Entry Rules

You assume full responsibility for verifying all passport, visa, vaccination, and entry requirements for all destinations and connecting points.


Many countries require passports to remain valid for six months beyond travel dates, and some countries restrict entry based on criminal history or require additional documentation for minors.


WhirlAway Travel is not responsible for denied boarding, denied entry, or travel disruptions related to documentation issues.


7. Price Drops and Price Increases

If a Supplier drops pricing after booking, we will attempt to assist with any permitted rebooking or repricing opportunities; however, we do not guarantee refunds or successful repricing.


Travel arrangements involving airline and cruise components may be subject to supplemental supplier or government-imposed price increases after booking. By authorizing payment, you consent to such increases where permitted under supplier terms and conditions.


8. Reservation Rule Violations

You agree not to purchase tickets containing flight segments you do not intend to use, including hidden-city, point-beyond, or back-to-back ticketing practices.


You acknowledge that airlines may cancel remaining portions of itineraries, revoke frequent flyer benefits, or impose additional penalties for such practices.


9. Insurance

For your protection, we strongly recommend purchasing comprehensive travel insurance including trip cancellation, interruption, medical, and evacuation coverage.


No representation or description of insurance by WhirlAway Travel constitutes a binding assurance regarding coverage or claim approval.


You agree to hold WhirlAway Travel harmless for your decision not to purchase insurance or for any denial of claim by an insurer.


10. Credit Card Merchant

We strongly recommend using a credit card for travel purchases.


When WhirlAway Travel processes payments on behalf of Suppliers, we act solely as an intermediary facilitating the transaction and remitting funds to Suppliers.


If a Supplier fails to provide services, your recourse shall be against the Supplier and not against WhirlAway Travel.


11. Claims Deadline and Exclusive Jurisdiction

You agree to present any claims against WhirlAway Travel within 30 days after completion of your trip and to file any legal action within one year of the event giving rise to the claim.


You agree that exclusive jurisdiction for all claims shall be in the state or federal courts located in Pennsylvania.


WEBSITE TERMS & PRIVACY POLICY

1. Scope of Services

WhirlAway Travel provides luxury travel planning, consultation, itinerary design, booking management, and related travel advisory services.


All travel arrangements are subject to availability and supplier confirmation.


Quotes, pricing, and availability may change until deposits are received and reservations are confirmed.


Pricing for custom itineraries is presented as a complete trip package. Line-item pricing for individual itinerary components is not typically provided.


2. Planning Fees & Cancellation Fees

Professional planning fees may apply based on the scope and complexity of your trip.


Planning fees are separate from the cost of travel and are non-refundable.


Additional planning fees may apply if the scope of work changes during the planning process.


If a confirmed trip is canceled, a cancellation fee may apply in addition to any supplier-imposed penalties.


3. Supplier Responsibility

WhirlAway Travel acts solely as an agent for airlines, hotels, cruise lines, tour operators, destination management companies, transportation providers, and other travel suppliers (“Suppliers”).


We are not responsible for the acts, omissions, delays, financial defaults, schedule changes, cancellations, service interruptions, or failures of any Supplier.


Supplier terms and conditions, including cancellation policies and penalties, apply independently and may be binding upon travelers.


4. Travel Risks & Traveler Responsibility

Travel involves inherent risks that may include weather events, illness, injury, pandemics, political instability, terrorism, transportation disruptions, labor strikes, natural disasters, and other unforeseen events.


Travelers assume all risks associated with travel.


It is the traveler’s responsibility to:

Review all travel documentation upon receipt

Verify that names exactly match government-issued identification

Confirm passport validity, visa requirements, vaccination requirements, and entry regulations

Monitor travel advisories and destination requirements

Ensure they are medically fit for travel


WhirlAway Travel is not responsible for denied boarding, denied entry, missed flights, passport or visa issues, or losses resulting from traveler documentation errors.

5. Travel Insurance

We strongly recommend the purchase of comprehensive travel insurance, including trip cancellation, interruption, medical, and evacuation coverage.


Coverage limitations and exclusions vary by policy. WhirlAway Travel does not guarantee coverage or claim approval by any insurance provider.


Travelers who decline insurance assume full responsibility for any financial loss related to travel disruptions or cancellations.


6. Pricing Changes & Airfare Rules

Airfare, cruise fares, taxes, fuel surcharges, and government-imposed fees may increase after booking.


By authorizing payment, travelers consent to supplier-imposed price increases permitted under supplier terms.


Travelers agree not to engage in prohibited airline booking practices including hidden-city ticketing, back-to-back ticketing, or intentionally unused flight segments.


7. Payments & Credit Card Authorization

By submitting payment information, travelers authorize WhirlAway Travel and/or travel suppliers to charge approved amounts for deposits, final payments, supplier penalties, and approved itinerary changes.


When WhirlAway Travel processes payments on behalf of suppliers, we act solely as an intermediary collecting and remitting funds.


8. Limitation of Liability

To the fullest extent permitted by law, WhirlAway Travel shall not be liable for:

Acts or omissions of third-party suppliers

Travel interruptions or delays

Personal injury, illness, death, or property damage

Losses resulting from weather, force majeure events, pandemics, labor disputes, or governmental actions

Financial default of suppliers

Loss of travel enjoyment or emotional distress


By using our services, travelers release and hold harmless WhirlAway Travel, its owners, employees, contractors, advisors, affiliates, and representatives from claims arising out of or related to travel.


9. Claims & Jurisdiction

Any claims related to services provided by WhirlAway Travel must be submitted in writing within 30 days of trip completion.


Any legal action must be filed within one year of the event giving rise to the claim.


Exclusive jurisdiction for any dispute shall be in the state or federal courts located in Pennsylvania.


10. Website Use

All website content, branding, text, graphics, itineraries, images, and intellectual property are owned by or licensed to WhirlAway Travel and may not be copied, reproduced, distributed, or used without written permission.


Users agree not to misuse the website, attempt unauthorized access, or interfere with website operations.
